Terms and Conditions of Use for the HEKAYAA application

Introduction

Welcome to the "HEKAYAA" application (hereinafter referred to as the "Application"). Please read these Terms and Conditions ("Terms") carefully before using the Application or any of the services provided through it. By using the Application, you agree to be bound by these Terms and Conditions and consider them a binding agreement between you and HEKAYAA Company ("the Company," "we," "us," "our"). If you do not agree to any part of these Terms, please do not use the Application.

1- Definitions

* Application: The mobile phone application named "HEKAYAA" and available on various application stores.

* User: Any person who browses or uses the Application in any way.

* Products: Food items available for sale through the Application.

* Order: A purchase request for Products submitted by the User through the Application.

* Account: The personal account created by the User on the Application.

* Content: All texts, images, videos, information, data, and other materials displayed on the Application.

2- Eligibility and Use

* You must be at least 18 years old or using the Application under the supervision of your parent or legal guardian.

* You must provide accurate and complete information when creating and using your Account.

* You are responsible for maintaining the confidentiality of your Account information, including your username and password, and you are responsible for all activities that occur under your Account.

* The Company has the right to suspend or terminate your Account if any unauthorized activity or violation of these Terms is suspected.

* The Application may not be used for any illegal purposes or purposes prohibited by these Terms.

3- Purchase and Payment Process

* Product Display: Available Products for sale are displayed on the Application with a detailed description, images (if any), and their prices. Prices and offers may vary from time to time without prior notice.

* Order Placement: You can select the Products you wish to purchase and add them to the shopping cart. Before completing the Order, you will be able to review and modify the contents of the shopping cart.

* Order Confirmation: Submitting an Order through the Application constitutes an offer from you to purchase the specified Products in accordance with these Terms. The Company reserves the right to accept or reject the Order in whole or in part. An Order confirmation notification will be sent to you via email or within the Application.

* Payment: Various payment methods are available and will be displayed during the order completion process. You must choose the appropriate payment method and provide correct payment information. You agree to pay the total amount of the Order, including the price of the Products, delivery fees (if any), and any applicable taxes.

4- Delivery

* Delivery Areas: The available delivery areas are specified on the Application. Please ensure that your delivery address is within these areas.

* Delivery Fees: Delivery fees may apply to orders, and these fees will be clarified before the payment process is completed. Delivery fees may vary based on the delivery area and the order value.

* Delivery Times: Estimated delivery times will be specified and communicated to you. However, the Company does not guarantee strict adherence to these times and may be affected by factors beyond its control.

* Order Receipt: You or your representative must be present at the specified delivery address to receive the Order at the scheduled time. You may be required to show a valid ID upon receipt.

* Non-Receipt: If you are unable to receive the Order at the scheduled time, additional fees may be applied, or the Order may be canceled.

5- Return and Exchange Policy

* The Company's return and exchange policy is subject to local laws and regulations related to the sale of food items.

* The return and exchange policy will be explained in detail on the Application or will be provided to you upon request.

* Generally, food products may not be returned or exchanged except in specific cases related to quality or damage upon receipt, and in accordance with the terms and procedures stipulated in the policy.

* You must inspect the Products upon receipt and report any damage or defect within a specified period.

6- Intellectual Property

* All intellectual property rights related to the Application and its content, including trademarks, logos, designs, texts, images, and software, are owned by the Company or its licensors and are protected by intellectual property laws.

* It is prohibited to copy, modify, distribute, or use any part of the Application's content without obtaining explicit written consent from the Company.

* You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Application in accordance with these Terms.

7- User Responsibility

* You are responsible for using the Application in a responsible and legal manner.

* You must not do any of the following:

  * Violate any applicable laws or regulations.

  * Impersonate any individual or entity.

  * Upload or publish any illegal, harmful, abusive, defamatory, or infringing content.

  * Interfere with the operation of the Application or attempt to access unauthorized parts of it.

  * Use any automated programs or tools to interact with the Application in an unauthorized manner.

8- Disclaimer of Liability

* The Application and its content are provided on an "as is" and "as available" basis without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

* The Company does not warrant that the Application will always be available or free of errors, viruses, or other harmful components.

* The Company shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of or inability to use the Application, including but not limited to loss of data or profits.

* The images displayed for the Products on the Application are for illustrative purposes only and may differ from the actual Products.

* You are responsible for ensuring that the Products you order are suitable for your needs, dietary preferences, and any allergies you may have.

9- Limitation of Liability

* To the maximum extent permitted by applicable law, the Company's total liability to you for any claim arising out of or relating to your use of the Application shall not exceed the total amount you paid to the Company for the relevant Order.

10- Amendments to the Terms and Conditions

* The Company reserves the right to amend or update these Terms and Conditions at any time without prior notice.

* The amended version of the Terms and Conditions will be published on the Application, and the amendment will become effective immediately upon publication.

* It is your responsibility to review these Terms and Conditions periodically for any changes. Your continued use of the Application after the publication of amendments constitutes your acceptance of the amended Terms and Conditions.

11- Governing Law and Jurisdiction

* These Terms and Conditions shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt.

* Any dispute arising out of or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Cairo, Arab Republic of Egypt.

12- General Provisions

* If any part of these Terms and Conditions is deemed invalid or unenforceable, the remaining parts shall remain in full force and effect.

* The Company's failure to exercise any right or provision of these Terms shall not constitute a waiver of such right or provision.

* The Company may assign its rights and obligations under these Terms to a third party without your consent. You may not assign your rights and obligations under these Terms to any other party without the Company's prior written consent.

* These Terms and Conditions constitute the entire agreement between you and the Company regarding the use of the Application and supersede all prior or contemporaneous agreements and understandings, whether oral or written.
